1. Overview
Residents of certain U.S. states may have specific privacy rights under applicable state privacy laws.
This U.S. State Privacy Rights Notice supplements the Commerce Foods Privacy Policy and explains additional rights that may be available depending on your state of residence, the type of personal information involved, how the information is used, and whether the applicable state law applies to Commerce International, LLC or Commerce Fulfillment LLC.
Wholesale / B2B services are provided by Commerce International, LLC.
Retail / B2C services are provided by Commerce Fulfillment LLC.
Nothing in this Notice is intended to provide fewer rights than applicable law requires.
2. State Privacy Laws
Depending on applicability thresholds and other legal requirements, state privacy laws may apply to residents of states including California, Colorado, Connecticut, Texas, Virginia, and other U.S. states that have enacted comprehensive consumer privacy laws.
Privacy laws vary by state. The rights described on this page apply only to the extent provided by applicable law. A right described here may not apply to every individual, every category of information, or every transaction.
3. Right to Know or Access
Where applicable, you may have the right to request confirmation of whether we process personal information about you.
You may also have the right to request access to certain personal information we maintain. Depending on applicable law, this may include information such as:
· categories of personal information collected;
· specific personal information maintained about you;
· categories of sources;
· purposes for collection or processing;
· categories of third parties to whom information is disclosed;
· categories of personal information sold or shared, where applicable.
4. Right to Correct
Where applicable, you may request correction of inaccurate personal information we maintain about you.
We may consider the nature of the information, the purpose for which it is processed, documentation you provide, and information already maintained in our records.
5. Right to Delete
Where applicable, you may request deletion of personal information.
Deletion rights may be subject to exceptions. For example, we may need to retain certain information to:
· complete a transaction;
· maintain accounting or tax records;
· detect or prevent fraud;
· maintain security;
· comply with legal obligations;
· resolve disputes;
· establish or defend legal claims;
· or for another legally permitted purpose.
6. Right to Data Portability
Where applicable, you may have the right to receive certain personal information in a portable and, where technically feasible, readily usable format.
The scope of portability rights depends on applicable law.
7. Right to Opt Out of Targeted Advertising
Residents of certain states may have the right to opt out of processing personal information for targeted advertising.
You may exercise this choice through Your Privacy Choices or, where available, [OPT OUT OF TARGETED ADVERTISING].
8. Right to Opt Out of Sale of Personal Information
Some state privacy laws provide a right to opt out of the sale of personal information.
We do not sell personal information for money in the ordinary meaning of the word “sell.” However, some state laws define “sale” more broadly.
Where applicable, you may opt out through Your Privacy Choices or [DO NOT SELL OR SHARE MY PERSONAL INFORMATION].
9. Right to Opt Out of Sharing
California provides qualifying consumers with the right to opt out of “sharing” personal information for cross-context behavioral advertising.
Where applicable, you may exercise this right through Your Privacy Choices or [DO NOT SELL OR SHARE MY PERSONAL INFORMATION].
10. Right to Opt Out of Certain Profiling
Certain state laws may provide a right to opt out of profiling used in furtherance of decisions that produce legal or similarly significant effects.
Where applicable, such rights may relate to decisions concerning areas such as:
· financial services;
· housing;
· insurance;
· education;
· employment;
· health care;
· access to essential goods or services.
Commerce Foods does not intend to use ordinary ecommerce browsing data to make such legally significant decisions about customers.
11. Sensitive Personal Information
Certain state privacy laws provide special protections for sensitive personal information. Depending on applicable law, sensitive information may include categories such as:
· account credentials;
· certain financial information;
· precise geolocation;
· government identifiers;
· biometric or genetic information;
· health information;
· racial or ethnic origin;
· religious beliefs;
· or other categories defined by law.
Where applicable, you may have the right to limit certain uses, withdraw consent, or request other protections regarding sensitive personal information.
12. Global Privacy Control and Universal Opt-Out Signals
Where required by applicable law, we recognize supported universal opt-out signals, including Global Privacy Control (“GPC”).
GPC may communicate an opt-out preference for sale of personal information, sharing, or targeted advertising.
If a valid signal is received, we will process it as required by applicable law.
13. Right to Appeal
Some state privacy laws allow consumers to appeal a decision concerning a privacy request.
If your request is denied and applicable law provides an appeal right, you may submit an appeal through the Privacy Request Form or by contacting support@commercefoods.com.
Please identify the request as: Privacy Appeal.
We will review and respond within the period required by applicable law.
14. Right to Non-Discrimination
We will not unlawfully discriminate against an individual for exercising a privacy right protected by applicable law.
Where prohibited, we will not unlawfully:
· deny goods or services;
· charge different prices;
· provide a lower level of service;
· retaliate;
· or otherwise penalize a consumer solely because the consumer exercised a protected privacy right.
15. California Privacy Rights
If you are a California resident and the CCPA applies to the applicable Commerce Foods entity, you may have rights including:
· Right to Know;
· Right to Access;
· Right to Delete;
· Right to Correct;
· Right to Opt Out of Sale;
· Right to Opt Out of Sharing;
· Right to Limit Certain Uses and Disclosures of Sensitive Personal Information;
· Right to Non-Discrimination.
California consumers may also have the right to receive notice at or before collection describing categories of personal information and purposes of use.
You may exercise applicable opt-out rights through Your Privacy Choices. Supported GPC signals will be processed as required by California law.
16. Colorado Privacy Rights
If you are a Colorado resident and the Colorado Privacy Act applies, you may have rights including access, correction, deletion, data portability, opt-out of sale, opt-out of targeted advertising, and opt-out of certain profiling.
Colorado also requires covered controllers to honor recognized universal opt-out mechanisms where applicable.
17. Connecticut Privacy Rights
If you are a Connecticut resident and the Connecticut Data Privacy Act applies, you may have rights relating to personal data and privacy choices.
Connecticut law applies to qualifying businesses based on statutory thresholds and gives residents rights concerning personal data while acting in an individual or household context.
Applicable requests may be submitted through our Privacy Request Form.
18. Texas Privacy Rights
If you are a Texas resident and the Texas Data Privacy and Security Act applies, you may have rights including:
· confirming whether personal data is processed;
· accessing personal data;
· correcting inaccuracies;
· deleting personal data;
· obtaining data in portable form;
· opting out of targeted advertising;

Different verification requirements may apply depending on the type of request, sensitivity of the information, and applicable state law.
Opt-out requests that do not require identification should not be subjected to unnecessary identity verification where prohibited by law.
22. Authorized Agents
Where applicable law permits, an authorized agent may submit a request on behalf of another individual.
We may request reasonable evidence that the agent is authorized to act on the consumer’s behalf. Where permitted, we may also contact the consumer directly to verify the request.

We will respond to qualifying privacy requests within the timeframe required by applicable law.
Different states provide different response periods and permitted extensions. Where an extension is permitted and reasonably necessary, we will provide notice as required.

Some state consumer privacy laws exclude or treat differently information processed in a business-to-business, employment, or commercial context.
Accordingly, rights available to an individual using the Site for personal retail purposes may differ from rights available to a representative of a wholesale business.
Where an applicable privacy law protects business-contact information, we will process qualifying requests in accordance with that law.
